Delishops to Customer Terms of Use

Who are we? 

Clicbox Ltd owns the Delishops Wholesale platform (“Delishops Wholesale”) 

How does it work? 

Delishops Wholesale is a sales and marketing platform connecting wholesale customers to suppliers of goods and services (“Suppliers”) who sell their products through the DeliShop Wholesale website direct to you the Customer. When you the Customer makes a purchase, that transaction is between you and the Supplier who owns, holds and dispatches the products. The Supplier is shown against each product description. Delishops Wholesale Ltd does not own, transport nor dispatch any products, and is not party to any transaction. Delishops Wholesale Ltd is an agent to the Supplier. 

Terms of Use

These Terms of Use (“ToU”) govern your use of the Delishops Wholesale platform. These are in addition to the Terms & Conditions of Suppliers. Each Supplier has their own Terms & Conditions (“Supplier T&Cs”) which they must abide by. Supplier T&Cs govern the price and delivery of products, cancellation and refund policies and other terms and conditions of sale, some of which are referenced to below. Please read the below carefully, as they relate to your purchase. If you do not agree to these Delishops Wholesale ToUs and/or our Privacy Policy, please do not use this website service. By making a purchase on the site you are accepting these Delishops Wholesale ToUs. 

Terms of use

      i.         The DeliShop website is free to use, but by using it you consent to Delishops Wholesale TOUsii.         When you purchase an item through the DeliShop, the legal contract is between you and the Supplier, the contact details for whom will be specified on your order confirmation. This will never be Delishops Wholesale and may or may not be the Retailer the DeliShop through which you are making the purchaseiii.         Nothing in Delishops Wholesale TOUs or the T&Cs of Suppliers affects your statutory rightsiv.         Delishops Wholesale TOUs may be updated at any time and published in the DeliShopv.         We reserve the right to refuse any transaction in any DeliShop 

Registration 

      i.         To use this DeliShop you must be 18 years or overii.         It is your responsibility to ensure that your personal details for purchase, payment and despatch are complete and accurateiii.         Payment will be required at confirmation of your order 

Security 

      i.         It is your responsibility to keep the password to your account safe and confidentialii.         You are responsible for all activities on your account under your passwordiii.         Each order made under your password requires you to pay for the goodsiv.         If Delishops Wholesale are made aware of any security concerns regarding your account we may close or suspend your account. Please contact support@delishops.co.uk if you cannot access your account 

Product price 

      i.         Price is confirmed at the time of ordering and is set by the Supplierii.         Unless otherwise specified, items sold by weight will be at the set weights shown on the website and may vary according to the tolerances set down by the relevant Supplier in their Suppliers T&Csiii.         Prices include VAT where applicable 

Availability and Substitutes 

      i.         All products are subject to availabilityii.         If a product is unavailable you will be contacted by email or telephone by the Supplieriii.          Delishops Wholesale are unable to make substitutes 

Alcohol 

      i.         To purchase alcohol you will be asked to confirm you are 18 years or overii.         If you select to collect direct from the Retailer via Click and Collect you may be asked to verify your age. We apologise if this is inconvenient for you 

Delivery 

      i.         Delivery terms and charges are shown on the product page and at checkoutii.         Delivery terms are subject to the Supplier T&Cs of each product. Delivery terms and Supplier T&Cs can be found in the tabs on the product pageiii.         Changes of address must be made on the website at or before the time of orderingiv.         If you need to change the address after this time, please contact the Supplier directly. Supplier details can be found herev.         Items delivered in error will not be charged to your account. Please notify the Supplier immediately if this is the case 

Receipt of goods

      i.         It is your responsibility to inspect goods on delivery for defects and to check your delivery is correct against your order confirmationii.         You must notify the Supplier as soon as possible of any discrepancies or defective produceiii.         Defective goods will be refunded. Do not dispose of defective items until you have received confirmation from the Supplier, as this could affect any refund you may be entitled to. It may be requested that you return the defective item to the Supplier 

Payment

      i.         Delishops Wholesale Ltd takes your payment on behalf of the Supplierii.         Payment can be made by MasterCard, Visa, Maestro, JCB, Delta and Switch credit or debit cardsiii.         We do not accept PayPaliv.         We do not accept American Expressv.         We do not accept cash or chequevi.         Payment is taken at the time the order is placedvii.         There is no additional charge for credit cards 

Changes to orders, cancellations and returns 

      i.         Changes, cancellations and returns of food goods are subject to the T&Cs of the Supplier from whom you have purchasedii.         Suppliers are listed here and stated on your order confirmation 

Perishable and customised goods 

      i.         Changes, cancellations and returns of food and customised goods are subject to the Supplier T&Cs from whom you have purchased. Suppliers are listed here and stated on your order confirmationii.         Refunds will only be given where goods are found to be defective on receipt. Evidence such as a photograph, or the return of the goods, may be required as proof the goods are defective. 

Other goods 

      i.         Changes, cancellations and returns of non-food goods are subject to the T&Cs of the Supplier from whom you have purchased.ii.         The Supplier are listed here and is stated on your order confirmation. 

Refunds 

      i.         Please refer to sections ‘Checking Your Delivery’ and ‘Changes to orders, cancellation and returns’ii.         Refunds will be processed within 14 days after goods have been received and verified by the Supplier if requestediii.         Delishops Wholesale process all refundsiv.         It is the responsibility of your Supplier to request from Delishops Wholesale a refundv.         If you are not happy with the service of your Supplier, you should contact Delishops Wholesale Ltd on support@delishops.co.ukvi.         If you have not received your refund or a refund acknowledgement from the Supplier after 15 days, you should contact Delishops Wholesale direct on support@Delishops.co.uk 

Warranty

      i.         Warranties and guarantees are as per the T&Cs of the Supplierii.         No warranties or guarantees are given by Delishops Wholesale for products sold by Suppliersiii.         The Delishops Wholesale platform gives no warranties for its use, or for general risks of using and buying products over the internetiv.         We at Delishops Wholesale do our best to provide timely and accurate information regarding Suppliers products and purchase terms. We make no warranties or guarantees for goods and content appearing on it, it is the responsibility of the Supplier to check and request any changes to incorrect information.v.         If you find any of the information contained in this DeliShop is inaccurate, we welcome your feedback on support@delishops.co.uk 

Technical concerns 

While Delishops Wholesale will do all that is reasonable at any time to provide a safe easy to use platform, we disclaim all liability fori.         Errors or interruptions to the DeliShop websiteii.         Incompatibility with any of your equipmentiii.         Malicious or dangerous software such as viruses 

You agree 

In the event Delishops Wholesale or the Supplier does not deliver against an intended purchase, Delishops Wholesale is not liable fori.         Damage to your revenue, profits, or cost reductions, direct or indirectii.         Collateral expenditure, direct or indirectiii.         Any other loss or damage arising from your use of the Delishops Wholesale platformiv.         Our liability is limited to the retail value of the goods purchased or intended to be purchased under this contractv.         Delishops Wholesale will not be deemed to have breached contract due to circumstances beyond our reasonable control 

Complaints, concerns or comments 

If you have any complaints, concerns or comments, you can contact us by email on support@delishops.co.uk. If you would like a call back please include your telephone number 

Viruses, hacking and other offences

You must not misuse our platform or any part of our service by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

New ToU will be published on the Delishops Wholesale platform
